The FTC has now delayed the enforcement date of the Red Flags Rule until December 31, 2010 while Congress considers legislation that would affect the scope of entities covered by the Rule.

In this podcast, Brian Lapidus, Chief Operating Officer of Kroll Fraud Solutions, cautions that while Red Flags Rule is a positive step towards protecting organizations and individuals from data breaches and identity theft, it is not a silver bullet. Criminals who steal data and commit identity theft are savvy individuals who pay attention and prey on the false sense of security created by rules and regulations. They are watching and figuring out new ways to attack companies and consumers for valuable personally identifiable information. Lapidus offers detailed examples about how more complex data breach scenarios can continue despite the passage of Red Flags Rule and how organizations will need to be vigilant and protect themselves after December 31, 2010.
